KernelTheory provides software consulting, development, and related technology services. By engaging our services, you agree to these terms.

2. Project Scope

All project deliverables, timelines, and costs will be agreed upon in writing before work begins. Changes to scope may affect timeline and pricing.

3. Intellectual Property

Upon full payment, all custom code and deliverables created for your project become your property. We retain rights to general methodologies and pre-existing tools.

4. Confidentiality

We treat all client information as confidential. We will not share your business information, code, or data with third parties without your consent.

5. Payment Terms

Payment terms are outlined in individual project agreements. Late payments may result in project delays or suspension.

6. Limitation of Liability

Our liability is limited to the total amount paid for services. We are not liable for indirect, incidental, or consequential damages.

7. Termination

Either party may terminate with 14 days written notice. Payment is due for all work completed up to termination date.

We collect information you provide directly: name, email, company details, and project requirements when you contact us or engage our services.

How We Use Information

We use your information to: provide services, communicate about projects, send relevant updates, and improve our offerings.

Data Security

1. General Policy

All payments made to KernelTheory are non-refundable unless explicitly stated otherwise in a signed project agreement. By engaging our services, you acknowledge and accept this policy.

2. Discovery & Consultation

Initial discovery calls are complimentary. The free Discovery Report offer is limited to one per client and carries no obligation. Once paid work commences, no refunds apply.

3. Milestone-Based Projects

Payment for each milestone is due upon delivery. Once a milestone is approved (explicitly or by proceeding to the next phase), it is considered final and non-refundable. Silence or non-response within 7 business days of delivery constitutes acceptance.

4. Scope Changes & Revisions

Revisions are limited to the scope defined in the project agreement. Requests outside the original scope constitute new work and will be billed separately. We are not obligated to provide refunds for scope misunderstandings not documented in writing.

5. Project Cancellation

If you cancel a project mid-engagement, all payments made for completed and in-progress work are non-refundable. Any unused prepaid amounts may be applied to future work at our discretion, but are not refundable as cash.

6. Limitation of Liability

KernelTheory's total liability shall not exceed the amount paid for the specific deliverable in question. We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, revenue, or business opportunities.

7. Disputes

All disputes must be raised in writing within 7 days of deliverable receipt. Disputes raised after this period will not be considered for any remediation or refund. Resolution is at KernelTheory's sole discretion.
